Rules for using the marketplace

Terms of Use

These Terms govern use of FindSpaceNow’s commercial lease marketplace, Space Brief alerts, listing inquiries, listing-submission tools, and broker workspaces.

Acceptance and eligibility

By accessing or using FindSpaceNow, you agree to these Terms and the Privacy Policy. You must be at least 18 and able to enter a binding agreement. If you use the service for a business, you represent that you have authority to bind that business.

Accounts and communications

• Provide accurate, current information and protect access to your account.
• Notify us promptly of suspected unauthorized use.
• If you activate a Space Brief or other requested alert, you authorize service-related email about those criteria. You can pause alerts or change eligible preferences.
• Marketing messages, if any, will include the choices required by applicable law. Service and transaction messages may still be sent when necessary to fulfill a request.

Listings and search results

Commercial real estate information can change quickly. Availability, rent, expenses, square footage, zoning, permitted use, condition, incentives, lease structure, broker identity, and other facts may be supplied by owners, brokers, public sources, or integrated platforms. FindSpaceNow may review or label information, but does not guarantee that any listing is complete, accurate, available, suitable, or free of third-party claims.

You are responsible for independent due diligence and for using appropriately licensed and qualified professionals before making a property or lease decision. A match score, “verified” label, alert, or recommendation is informational and is not a promise that a transaction will occur.

Broker and listing submissions

If you submit or synchronize a listing, you represent that you are authorized to do so and that the information is accurate to the best of your knowledge. You grant FindSpaceNow a nonexclusive, worldwide, royalty-free license to host, reproduce, format, distribute, and display the submitted content solely to operate, improve, market, and secure the service.

We may review, correct formatting, request substantiation, reject, suspend, or remove content that is inaccurate, stale, unlawful, misleading, duplicative, or inconsistent with these Terms. Imported professional profiles do not by themselves create or verify an account, license, agency relationship, or right to claim a listing.

Permitted use

You may use FindSpaceNow for legitimate commercial lease searches, listings, inquiries, and related business workflows. You may not:

• Scrape, harvest, bulk download, resell, or republish the service or listing database without written permission.
• Submit false listings, impersonate another person, misrepresent authority, or route inquiries deceptively.
• Attempt to bypass access controls, interfere with security, introduce malicious code, overload the service, or reverse engineer protected portions of the service.
• Use the service to violate fair-housing, anti-discrimination, privacy, intellectual-property, communications, licensing, or other applicable laws.

Intellectual property

FindSpaceNow, its software, design, branding, and original content are owned by or licensed to FindSpaceNow and are protected by applicable intellectual-property laws. These Terms provide a limited, revocable, nontransferable right to use the service; they do not transfer ownership.

Third-party services and links

The service may contain content, links, maps, analytics, hosting, communication, or data supplied by third parties. Their services and policies govern their own systems. FindSpaceNow is not responsible for third-party availability, content, security, or transactions.

Service changes and suspension

We may change, test, suspend, or discontinue features and may restrict access when reasonably necessary for security, maintenance, legal compliance, or enforcement. We may suspend or terminate accounts that violate these Terms.

Disclaimers

To the maximum extent permitted by law, the service is provided “as is” and “as available.” FindSpaceNow disclaims implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant uninterrupted operation, error-free data, particular search results, successful alerts, broker responses, negotiations, or completed transactions.

Limitation of liability

To the maximum extent permitted by law, FindSpaceNow and its affiliates, personnel, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, lost opportunities, or lease and property decisions arising from use of the service. FindSpaceNow’s aggregate liability for claims relating to the service will not exceed the greater of $100 or the amount you paid FindSpaceNow for the service during the twelve months before the claim. Some jurisdictions do not permit certain limitations, so they may not apply to you.

Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless FindSpaceNow and its affiliates and personnel from claims arising from your submitted content, misuse of the service, violation of these Terms, or infringement of another person’s rights.

Governing law

These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law rules. Courts located in Maricopa County, Arizona will have exclusive jurisdiction, except where applicable law requires otherwise.

Changes and severability

We may update these Terms by posting a revised effective date and additional notice when appropriate. Continued use after an update constitutes acceptance where permitted by law. If a provision is unenforceable, the remaining provisions remain in effect. Failure to enforce a provision is not a waiver.
